By purchasing or using server services from Raidbox (We, Us, Our), a company under Ox2 Net Corp., located in Vancouver, British Columbia, Canada, with email contact at info@raidbox.xyz, You (Customer) agree to these Server Terms and Conditions ("Server T&Cs"). The provisions contained in these Server T&Cs incorporate and are supplemental to Raidbox’s General Terms and Conditions of Service ("GT&C"), by which you are also bound.
GENERAL SERVER TERMS
1.1. Your Obligations
1.1.1. Data Backup Obligations
You are solely responsible for backing up Your data in accordance with Our GT&C. Raidbox assumes no responsibility for data loss, corruption, or recovery.
1.1.2. Obligation to Inform
If You have reason to believe that a third party is using Your server, platform, or services without authorization, You must inform Us immediately via info@raidbox.xyz.
1.1.3. Fair Use and Content Obligations
You agree not to offer, disseminate, or provide links to copyrighted content without proper authorization. You agree not to use the services for P2P exchanges, download services, streaming services, or any activities that may facilitate the illegal dissemination of copyrighted materials.
1.1.4. Crypto Mining
You agree not to use the resources, servers, or services provided by Raidbox for mining cryptocurrencies or any similar high-resource intensive activities without prior written consent.
1.1.5. Liability for Third-Party Content
Importing, installing, or using operating systems, images, applications, or any external/third-party content is done entirely at Your own risk. We assume no liability for third-party content, applications, or any damage resulting from their installation or use.
1.1.6. Obligations to Co-operate
You agree to follow any technical instructions provided by Us. You agree to co-operate with and implement software upgrades or changes recommended by Raidbox for maintaining security, stability, and performance of the services. We accept no liability for consequences resulting from Your failure to do so.
1.1.7. License Obligations
You agree to comply with all license requirements, including those from third parties. You must maintain possession of valid original software licenses for any software used on the servers. We may request proof of licenses at any time.
1.2. Our Rights
1.2.1. Migration and Modification Rights
We reserve the right to migrate Your server, server software, or components for technical, security, or operational reasons (e.g., end-of-life software, security vulnerabilities). We may modify available applications, versions, or features at any time, including offering alternative versions deemed appropriate.
1.2.2. Access, Suspension, and Termination Rights
We reserve the right to disconnect or suspend Your server from the network without prior notice if You breach any obligations under this Agreement or the GT&C. You will be notified as soon as practicable if such action is taken. In cases of breach, We may terminate Your contract without notice.
SPECIAL SERVER TERMS
2.1. Dedicated Server / VPS / Cloud Server (General)
2.1.1. Subject of the Agreement
These server types (Dedicated Server, VPS, Cloud Server, or similar) provide administration rights (root/admin access). They require advanced knowledge of server system administration. We have no administrative access to Your server unless explicitly stated otherwise.
2.1.2. Your Obligations
2.1.2.1. As server administrator, You are solely responsible for securing the server against unauthorized access, attacks, or manipulation by third parties.
2.1.2.2. You are solely responsible for updating operating systems, applications, and software installed on the server, at Your own cost and risk.
2.1.2.3. You are responsible for installing and maintaining reliable security software (e.g., firewalls, antivirus) to prevent abuse of the server or network.
2.1.2.4. You agree to configure programs to automatically restart upon hardware or operating system restarts.
2.2. Billing and Fees (Applicable to Cloud/Flexible Models)
Fees are based on resources consumed and/or fixed monthly charges, as detailed on Our website or in Your account panel. Billing may be pay-as-you-go (accurate to the minute/hour) or term-based. Fixed resources (e.g., additional IPs, licenses) are non-refundable if removed mid-term. We reserve the right to reduce bandwidth or suspend services in cases of excessive or improper use.
2.3. Backup Services (If Offered)
2.3.1. You are solely responsible for configuring, managing, and securing backups. Raidbox provides the platform but assumes no liability for data loss, deletion, corruption, or recovery in backups.
2.3.2. We may access physical infrastructure for technical resolution but have no administrative access to Your backup content.
2.3.3. Services may be terminated after prolonged non-use (e.g., 6 months). Fees are based on storage used or fixed packages, with overage charged accordingly.
GOVERNING LAW AND JURISDICTION
These Server T&Cs shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of British Columbia, Canada.
You expressly agree and acknowledge that, except as modified by these Server T&Cs, Your use of the server services is subject to the entirety of the GT&C, including but not limited to sections on limitation of liability, no responsibility for Your data, no tax charging, indemnification obligations, and exclusive jurisdiction in British Columbia courts. The GT&C and Server T&Cs may be updated from time to time, and Your continued use constitutes acceptance of any modifications.
