Raidbox List Local – Terms and Conditions
Applicability
The following conditions apply to the Raidbox List Local service. In addition to these terms, the Raidbox General Terms and Conditions of Service also apply. If these terms contradict the Raidbox General Terms and Conditions, these terms take precedence.
Subject Matter
2.1. During the term of the contract, you have the opportunity to create an entry for yourself or a third party and publish it in various online business directories, company directories, and social networks on the Internet (hereinafter “media presenters”). Raidbox will transmit the profile data you save in List Local to the media presenters in full, but does not guarantee that the media presenters will always apply this data immediately, correctly, or in its entirety. The number and selection of media presenters depend on the selected package and may change at any time without affecting the validity of the contract with Raidbox. Media presenters may collaborate with partners operating networked online services for broader distribution of your content. These additional entries on partner sites are a voluntary extra service over which Raidbox has no influence and which may change or be discontinued at any time. Changes to these voluntary services do not affect the validity of the contract with Raidbox.
2.2. Depending on the List Local package, an interface may allow you to respond to reviews on selected media presenters, publish responses, news, and offers (hereinafter “posts”) during the contract term, provided the respective media presenter supports such posts and you have any required registration with them. Raidbox transmits your posts to the media presenter but does not guarantee correct or complete application. Implementation and presentation of posts are handled by the media presenter according to its own terms of use. The number and selection of media presenters, as well as the scope of possible posts, depend on the package and may change at any time without affecting the contract with Raidbox.
Entries or Information for Third Parties
If you create an entry or post for a third party, you must obtain that third party's prior consent to the use and publication of their data or posts.
Your Obligations
4.1. Any entry or post you create must contain only content for which you hold the necessary rights (in particular intellectual property and related rights) and which does not violate third-party rights or any laws. You must possess the required rights or permissions that also cover use by Raidbox and media presenters for the purposes of this service. Entries and posts containing violence-glorifying, insulting, racist, discriminatory, erotic, pornographic, political content, or content related to tobacco, alcohol, drugs, weapons, and/or gambling are expressly prohibited.
4.2. You must comply with the terms of use of the respective media presenters in all entries and posts.
Review
Raidbox is not obligated to screen your entries or posts for potential legal violations. Failure to notify you of any infringing content does not constitute waiver or acceptance by Raidbox.
Editing
Raidbox and media presenters are entitled (but not obligated) to edit your entry to adapt it to their content structure.
Usage Rights
You grant Raidbox a non-exclusive, worldwide, irrevocable, fully sublicensable, royalty-free, and unlimited license to store, duplicate, distribute, modify, display, and publish your entry or post in connection with the Raidbox List Local service. This license may be transferred for publication purposes.
Indemnification
You shall indemnify Raidbox against all third-party claims arising from your breach of obligations in sections 4 and 5 or any harmful actions, and compensate Raidbox for any resulting damages, including costs of legal action or defense.
